Although the City
could appeal the ruling, this would be a lengthy process and would further
delay any plans for the area. The EHOA
Board does not believe this is likely.
Attempting to take the land by eminent domain would also lead to bitter
lawsuits and delays. Instead the
developer could negotiate with the individual property owners in the area to
establish a fair price for the land. Or
it could start the whole process again from scratch.
But the billion
dollar question is: Where is the money?
Does the developer have the funds, or are they fooling everybody?
The $500 million
plan changed the area's zoning to “mixed-use”, and called for building two
hotels, two office buildings, residences, and retail stores in the sixty-acre
site bounded by Route 4 to the north and Route 95 to the south.
